How the process works

The Notary Process

We aim to make notarization straightforward. Please review these steps before your appointment so your documents can be completed without unnecessary delays.

1. Schedule your appointment

Contact Fiotax to request a notary appointment. Tell us:

  • The type of document you need notarized
  • How many signers will be present
  • Whether witnesses are required
  • The date and time you need the document completed
  • Whether the document involves an acknowledgment, affidavit, sworn statement, jurat, or another notarial certificate
  • Whether you need any additional service, such as a certified copy request or apostille-related guidance

Appointments help us confirm availability and ensure you bring the right people and identification. Walk-ins are welcomed as well.

Important note:
Not all documents can be notarized, and some documents have special witnessing, identification, language, or execution requirements. Please contact us before your visit if you are unsure.

 

2. Bring the complete, unsigned document

Bring the entire document, including all pages, exhibits, attachments, and notarial certificate wording.

Before you arrive:

  • Complete all non-signature portions of the document, where appropriate
  • Do not leave blank spaces that could materially change the document later
  • Do not sign the document before meeting the notary if your document requires the signature to be witnessed
  • Make sure the notarial certificate is included or confirm what type of notarization the receiving party requires
  • Bring any instructions supplied by the bank, government agency, attorney, title company, court, school, employer, or other recipient

We cannot determine which type of notarization your receiving party requires. If the document does not state the notarial act needed, ask the organization receiving the document before your appointment.

Example:
If a title company requests an “acknowledgment,” confirm that requirement with the title company before you arrive. If an affidavit requires a sworn statement, the signer may need to take an oath or affirmation before signing.

 

3. Bring acceptable government-issued photo identification

Every signer must present valid, satisfactory identification. The name on the ID should reasonably match the name shown on the document.

Common forms of identification may include:

  • A current state-issued driver license
  • A current non-driver photo identification card
  • A U.S. passport
  • Another valid government-issued photo ID that is acceptable under New York notarial requirements

Please bring the original physical ID, not a photocopy, screenshot, or expired document unless you have confirmed in advance that it can be accepted.

The notary must be satisfied that each signer’s identity has been established. If acceptable identification is not available, the notarization may need to be postponed.

 

4. All signers must personally appear

Each person whose signature must be notarized must personally appear before the notary. For traditional paper notarizations, this generally means appearing in person at the scheduled appointment.

The signer must be:

  • Present before the notary
  • Able to communicate directly with the notary
  • Willing to sign the document
  • Aware of the nature of the document being signed
  • Free from apparent coercion, pressure, or incapacity

A notary cannot notarize a signature for someone who is absent. A spouse, family member, employee, friend, or representative generally cannot sign for another person unless the document and applicable law specifically authorize it—and the appropriate signer is personally present.

 

5. Sign only when instructed

Do not sign the document until the notary instructs you to do so, unless the document was already signed under circumstances that permit acknowledgment of a prior signature.

Depending on the document, the notary may ask you to:

  • Sign the document in the notary’s presence
  • Confirm that an existing signature is your own
  • Acknowledge that you signed willingly
  • Swear or affirm that statements in the document are true
  • Sign the notary’s journal or record of the notarial act, when required

For a document requiring an oath or affirmation, the signer must personally make the required statement before the notary. The notary cannot administer an oath on behalf of someone who is not present.

 

6. The notary completes the notarial certificate

After verifying identity and completing the required notarial act, the notary will complete the certificate section of the document. This typically includes:

  • The date and location of the notarization
  • The type of notarial act performed
  • The signer’s name
  • The notary’s signature
  • The official notary stamp or seal, as applicable
  • The notary’s commission information
  • Any required journal or record entry

7. Review the completed document before leaving

Before you leave, carefully review the notarized document to confirm:

  • Every required signer signed where needed
  • The notarial certificate is complete
  • The date is correct
  • The signer’s name is properly reflected
  • All required pages and attachments are included
  • Any witness signatures have been completed, if applicable

Once you leave, changes to the document may require a new notarization. Never alter a notarized document after the notarial act has been completed.

Frequently Asked Questions

Do I need an appointment?

Appointments are recommended. They help ensure that a commissioned notary is available and that you bring the correct documents, identification, signers, and witnesses.

Can I bring a document already signed?

It depends on the required notarial act. For an acknowledgment, you may be asked to confirm that an existing signature is yours and that you signed voluntarily. For a jurat or sworn affidavit, you may need to sign in the notary’s presence and take an oath or affirmation. When in doubt, do not sign until you meet with the notary.

Can Fiotax tell me what type of notarization I need?

No. The receiving organization, attorney, title company, court, government agency, bank, school, or other document recipient should tell you whether you need an acknowledgment, jurat, oath, affidavit, or another form of notarization.

Can a notary notarize a document without the signer present?

No. The signer must personally appear before the notary, whether in person or, when legally available and properly arranged, through a compliant electronic-notarization process.

What identification do I need?

Bring a current, original government-issued photo ID. The notary must be satisfied that the signer’s identity has been established before completing the notarization.

Can you notarize documents in another language?

The signer must be able to communicate with and understand the notary and the document being signed. Contact Fiotax in advance if the document is in another language or an interpreter may be needed.

Can Fiotax provide witnesses?

Please ask when you schedule. Documents may require independent witnesses, and witness availability cannot be guaranteed. The signer is responsible for confirming the document’s witness requirements with the receiving party or legal adviser.

Is notarization the same as legal advice?

No. Notarization verifies identity and the signing process; it does not validate the legal content, accuracy, enforceability, or acceptability of the document.

Do you provide apostille services?

A notarization and an apostille are different. An apostille is a separate authentication process generally used for documents intended for use outside the United States. Fiotax may be able to explain the practical submission process or help organize documentation as an administrative service, but an apostille is issued by the appropriate government authority—not by the notary.
